How much late fee can you charge on an invoice?

The standard range is 1% to 1.5% per month (12-18% annually) or a flat fee of $25-$50 for smaller invoices. Charge within that band and nobody will blink; charge 5% a month and you may run into regional interest caps and reasonableness pushback.

The one rule that makes late fees enforceable

The client must have agreed to the fee before being late. A late fee that first appears on an overdue invoice is a request, not an obligation. Put the terms in two places:

  1. Your contract - "Overdue balances accrue interest at 1.5% per month."
  2. Every invoice - a footer line: "A late fee of 1.5% per month applies to balances unpaid after the due date."

Do this from the first invoice with every client. Adding fees mid-relationship feels punitive; having them from day one is just policy.

How do you calculate a monthly late fee?

Fee = invoice amount x monthly rate x (days late / 30)

A $3,000 invoice at 1.5% per month, 45 days late: 3,000 x 0.015 x 1.5 = $67.50. Modest - which is the point. The fee is a signal, not a profit center.

Should you actually charge it?

Use the late fee as leverage, not revenue:

  • Mention it before charging it - "I'd rather not apply the late fee - can we settle this by Friday?" collects faster than surprise charges
  • Waive it graciously once for good clients who slipped - you bank goodwill
  • Charge it without apology for repeat offenders - some clients pay whoever nags loudest; the fee moves you up their list

What if the client refuses to pay the fee?

Decide what you're optimizing for. If the principal arrives but the fee doesn't, most professionals take the win and note the client's behavior for future terms (deposits, shorter terms, or declining the work). If neither arrives, the fee strengthens your position in a formal escalation.

The best late fee is prevention
